These Terms and Conditions, together with any and all other documents referred to herein, set out the terms of use under which you may use this website, www.legendsandmyths.co.uk (“Our Site”).  Please read these Terms and Conditions carefully and ensure that you understand them. Your agreement to comply with and be bound by these Terms and Conditions is deemed to occur upon your first use of Our Site.  They provide information about us and the legal terms and conditions on which we sell any of the product(s) listed on our website www.legendsandmyths.co.uk to you. 

These terms will apply to any contract between us for the sale of product(s) to you. Please read these Terms carefully and make sure that you understand them, before ordering any Product(s) from our site. Please note that by ordering any of our product(s), you agree to be bound by these Terms and the other documents expressly referred to in them. If you do not agree to comply with and be bound by these Terms and Conditions, you must stop using Our Site immediately.

Definitions and Interpretation

In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings: “Content” means any and all text, images, audio, video, scripts, code, software, databases and any other form of information capable of being stored on a computer that appears on, or forms part of, Our Site; and “We/Us/Our” means Martyn Krzywon (t/as RYNEK360 sub-brand legendsandmyths.co.uk).

Access to Our Site is free of charge and it is your responsibility to make any and all arrangements necessary in order to access Our Site. Access to Our Site is provided “as is” and on an “as available” basis.  We may alter, suspend or discontinue Our Site (or any part of it) at any time and without notice.  We will not be liable to you in any way if Our Site (or any part of it) is unavailable at any time and for any period. 

Our Product(s)

Images of the product(s) on our site are for illustrative purposes and although we have made every effort to display the colours accurately, we cannot guarantee that your computer’s display of the colours accurately reflect the colour of the product(s) which may vary slightly from those images. We have made every effort to be as accurate as possible because our product(s) are hand finished, all sizes, dimensions and measurements indicated on our site are approximate due to different suppliers. 

How our contract is formed

After you place an order, you will receive an e-mail from us confirming that we have received your order. If we are unable to supply you with a product(s), for example because that product(s) is not in stock or no longer available, or because of an error, we will inform you of this by e-mail and we will not process your order. If you have already paid for the product(s), we will refund you the full amount as soon as possible. You will be able to modify or cancel your order, before it is dispatched, for up to one hour after by sending us an email at office@legendsandmyths.co.uk. We may revise these terms from time to time.

Your consumer right of return and refund if delivery damage occurs

If you are a consumer, you have a legal right to cancel a contract under the Consumer Protection (Distance Selling) Regulations. This means that during the relevant period if you change your mind or for any other reason you decide you do not want to keep a product(s), you can notify us of your decision to cancel the contract and receive a refund. This cancellation right does not apply in the case of any made to order print sourced and that are made to your requirement. Your legal right to cancel a contract starts from the date of the order confirmation. If the product(s) have already been delivered to you, you have a period of 14 days in which you may cancel, starting from the day you ordered the product(s). To cancel a contract, send an e-mail to office@legendsandmyths.co.uk and keep a copy of your cancellation notification. If you send us your cancellation notice by e-mail it is effective from the date you sent the email. If the product(s) is damaged, you will receive a full refund of the price you paid for the product(s) and the original delivery charges (unless delivery was free of charge). We will process the refund as soon as possible, within 30 calendar days of the day on which you gave us notice of cancellation. If you have returned the product(s) because they are faulty or mis-described, we will refund the price of a defective product(s) in full and any applicable delivery charges. We refund using the same payment method that was used to purchase the product(s). If the Product(s) were delivered to you, you must return the product(s)(s) to us as soon as reasonably practicable and unless the product(s) are faulty, you will be responsible for the delivery cost. 

Delivery

Your order will be fulfilled by the estimated delivery date set out in the information provided to you by Royal Mail. If we are unable to meet the estimated delivery date, we will contact you with a revised estimated delivery date. Delivery will be completed when we deliver the product(s) to the address you gave us and they will be your responsibility from the completion of delivery. You own the product(s) once we have received payment in full.

Price of product(s) and delivery charges

Prices will be quoted on our site from time to time and we take all reasonable care to ensure that the prices of Product(s) are correct at the time when the relevant information was entered onto the system. Prices may change from time to time, but changes will not affect any order which we have confirmed with an Order Confirmation. The price of a product(s) includes delivery charges for delivery to addresses in the United Kingdom. Royal Mail international service charges apply for dispatch to addresses outside the United Kingdom and are displayed in the shopping cart.

How to pay

You can pay for product(s) using most major debit cards, credit cards.  We use Stripe for secure transactions. Your debit or credit card details and personal information is secure when using our website. We use industry standard encryption to protect your personal information and card details and do not store your card information on our website. Your personal details are stored securely and will not be passed to a third party.

Visitor Provided Material

Any material that a visitor to this website sends or posts to this website shall be considered non-proprietary and non confidential. We shall be entitled to copy, disclose, distribute or use for such other purpose as we deem appropriate all material provided to us, with the exception of personal information, the use of which is covered under our Privacy Policy. 

When using this website you shall not post or send to or from this website any material:

  • For which you have not obtained all necessary consents;
  • That is discriminatory, obscene, pornographic, defamatory, liable to incite racial hatred, in breach of confidentiality or privacy, which may cause annoyance or inconvenience to others, which encourages or constitutes conduct that would be deemed a criminal offence, give rise to a civil liability, or otherwise is contrary to the law in the United Kingdom;
  • Which is harmful in nature including, and without limitation, computer viruses, Trojan horses, corrupted data, or other potentially harmful software or data.

We will fully co-operate with any law enforcement authorities or court order requiring us to disclose the identity or other details of any person posting material to this website in breach of our visitor provided materials terms and conditions above.

All Content included on Our Site and the copyright and other intellectual property rights subsisting in that Content, unless specifically labelled otherwise, belongs to or has been licensed by Us.  All Content is protected by applicable United Kingdom and international intellectual property laws and treaties. These Terms and Conditions, and the relationship between you and Us (whether contractual or otherwise) shall be governed by, and construed in accordance with the law of the United Kingdom (England & Wales, Northern Ireland & Scotland]. If you are a consumer, any dispute, controversy, proceedings or claim between you and Us relating to these Terms and Conditions, or the relationship between you and Us (whether contractual or otherwise) shall be subject to the jurisdiction of the courts of England, Wales, Scotland, or Northern Ireland, as determined by your residency.
